Legislative authority within the Town rests with the Town Board, which serves as the Town’s governing body.
Among its many responsibilities, the Town Board fills vacancies in both elective and appointive town offices and may appoint a Town Attorney, Town Engineer, constables, or police officers. The Board also authorizes the hiring of additional employees as needed to conduct town business, in accordance with New York State Town Law. Certain highway employees are appointed by the Highway Superintendent, subject to funding levels approved by the Town Board.
The Town Board adopts the annual budget, establishes salaries for town officers and employees, sets its own rules of procedure, and designates the Town’s official newspaper. In addition, the Board is empowered to authorize and oversee a wide range of municipal functions and services, including—but not limited to—drainage and flood control projects, fire protection and fire alarm districts, improvement districts, traffic control measures, public health initiatives, and other town improvements. The Board may also sponsor community programs and events, settle claims, call special town elections, license certain occupations, and designate approved depositories for Town funds.
The powers and duties of the Town Board are primarily defined in Section 64 and other provisions of New York State Town Law, with additional authority granted under related statutes such as the General Municipal Law, Highway Law, Education Law, Agriculture and Markets Law, and the Not-for-Profit Corporation Law. Furthermore, the Town Board may adopt local laws under the home rule authority provided by Article IX of the New York State Constitution and the Municipal Home Rule Law.
